Legal Question in Personal Injury in California

i was recently behind a city truck when some debris fell off of it and i was forced to break extra fast and myself and my husband were thrown violently forward . i got info from the truck driver after he stopped to do a job . we both went to the hospital and we both have sore necks.. can i sue to receive something for my pain and suffering. what about hospital bills thank you

Yes, you can sue, but most public entites are not very generous is settling cases, and with the economic downturn it probably has gotten worse. You first need to get a formal claim form from that City, file it out, and submit it before 180 days from the date of the accdient. You should get copies of the medical records for your treatment and the bills, along with any property damage to your vehicle and proof of any other damages [wage loss, etc.] The City will likely reject the claim as they do with almost all claims against them, and you will have to sue in Small Claims court [there are several books, including from Nolo Press].
