Legal Question in Personal Injury in California

Reluctant Manager

I went to a bookstore w/ cafe. I found an empty sofa and was reading a book about 10 minutes. Then, this guy came over and insisted that it was his sit. I told him that I was just sitting in an empty chair. He shouted ''what kind of word do you undertand me, I was sitting here and I just went to get coffee.'' I told him again that I sat down b/c it was empty. Then he started swear f and b words then pour hot coffee to my head. He ran toward the door and I asked help and yelled to security person to stop him. She would just look at me and him and did not move nor take any action. I was very surprised. I asked her why she would not do anything and she replied that it was not her responsibility. In addition, after I asked a store manager, store manager said there is nothing she can do. I felt very violated since this is the bookstore chain, and the way I get treated. She said ''only thing I can do is to call the poilice.'' So, until the police came, (about 30 min later) I had to just stay in fron of the door w/ my wet clothes. Not even store manager offered to get doctor or anything. Police said they will try, but I doubt they can do anything at this point. Can I file a claim against this store and the security company?

I don't know when this happened, but if it is not too long ago, try getting video surveillance tapes from the store if you can. Ask the police detective to do it for you as the store will likely cooperate with the police much better than with you. Should you get this piece of evidence, you will have a good case against the person who assaulted you and the store, if it corroborates your story.
