Legal Question in Personal Injury in California

settlement

my lawyer has received the check for a personal injury from the insurance company and i have signed it to be deposit in his personal trust account. it has been two months since the settlement day and i have not received my payment yet. is that normal?

No. Two months is too long for a check to clear. If you do not get a satisfactory response from your lawyer (and your money and an accounting) contact the State Bar Association and file a written complaint. They will investigate. You may have to sue the lawyer. Who knows?

That is not usually normal. However, are there bills that need to be paid, like a lien from Medi-Cal or Medicare? That may delay things. Call your attorney and ask him why there is a delay.

No. Write a certified letter to the attorney asking for a response. If he doesn't respond, file a complaint with the state bar.

Add to the letter that you have been told if he does not respond within 5 business days you should report him to the State Bar ad start looking for an attoreny to file suit against him.
