Shoulder injury by possible employee negligence

I am 25 years of age.

I was at a Laser Tag venue for a friends birthday party at the time of the injury.

The business has a bay door like entrance to the laser tag room and was left half way open during the match. The door should normally be all the way up, or completely shut during business hours, however it was left open half way during the laser tag match.

I was trying to avoid another player and was closelined and knocked to the ground by the half closed, steel bay door and sustained a horrible shoulder injury.

I have pictures to support the injury, but did not go to the hospital, even though i know i should have. I was in so much back pain and shoulder pain at the time of the injury i could not even get into a vehical without assistance (witnesses can vouch for this).

My question is this: this happend a little over a year ago, but now the same shoulder that was injured has a re-occuring popping sound whenever i rotate my shoulder a certain way during physical activity. The sound and re-occuring pain started to happen shortly after the visual effects of the injury began to subside. I've had shoulder problems every since.

what can be done about this legally? Thank you for any help in the matter.

The statute of limitations for personal injuries is now two years from the date of the incident. You may have a basis to claim the owner of the business was negligent, but they are going to question why you waited so long and why your shoulder still hurts a year later. You need to go to some personal injury plaintiff's lawyers in your area and talk to them and find out what they think the chances are of getting anything and how much. First check to see that the owner of the business still owns the business so that you have someone to sue.

Should you file suit, be prepared for arguments by the defense that you were voluntarily engaged in an inherently risky sporting activity, and thereby assumed the risk of such injury. I would imagine the laser tag room has a number of obstacles and hazards to enhance the experience, any of which could have caused a similar injury.

The statute of limitations is two years for personal injury now in CA. You better contact an injury lawyer and pursue your rights.
