Legal Question in Personal Injury in California

Shuttle on fire

I am a student in LA. I took a shuttle from airport to my apt and it caught fire in the rare end. We asked the driver to stop but he did not. When he finally did we managed to come out but all my luggage was burnt. PLease advice. I am left with nothing.

Property damage is only one aspect of the case! You are also entitled to emotional pain and suffering, as well as any medical expenses and physical pain and suffering caused by smoke inhalation.

If you were my client, I would have you examined by a medical doctor right away, and also by a psychotherapist for the mental trauma (and maybe a psychiatrist depending on the severity of the trauma).

His company (most likely handled by their insurance company) would certainly be liable for the damage.

Have you provided them with a formal demand to compensate for your property loss?

I think your best and easiest option would to calculate the total value of all your belongings, plus other expenses, e.g. incidental damages such as cost for other transportation, etc, then put a claim in with the carrier�s insurance company. Be sure to submit all the supporting documentation with your claim, receipts, photos, police reports, fire department reports, etc.

If they blow you off, then you can sue them in small claims court for your damages if they total $7,500.00 or less. It is important to note however, even if your damages run closer to $10,000.00, it is a headache suing in superior court and you might want to cut your losses. It is my opinion that you should avoid litigation and instead, try to keep your life simple and concentrate on doing well at U.C.L.A.

Unless you actually suffered a personal injury of sort, I would not bother with a personal injury aspect of your case. Way too often, those who believe that they have injuries run to lawyers and doctors, build up a case only to learn that the ones who make money are the attorneys and doctors. But, giving some credit towards the other side, sometimes the potential plaintiff doesn�t know they�re injured. Both sides must be considered after such an incident.

You would make a claim with the shuttle service. Itemize all your personal property, gather receipts and bills (just as if there was a fire in your apartment) and submit them to the ins carrier for the shuttle service.
