Legal Question in Personal Injury in California

Side-swiped changing lanes.

I was exiting a gas station driveway onto a three lane one way road. I looked to my left as I was exiting and there was absolutely no traffic. I crossed the first lane (this all happened in a matter of seconds) uneventful, the second lane uneventful. When I started into the third lane all the sudden "WHAM". I have no idea where this car came from. He basically side swiped the drivers side of my car from the very rear to about the mid section. The only two places he could have come from was either turning left onto the street I was on or right. Who was in the wrong here. His car sustained absolutely no damage. My car has dents and scrapes all along the side, and I have a back injury. After the accident he did pull up beside me and stated "God, I am so sorry, are you alright" What would be the law of lane changing in this situation?

Re: Side-swiped changing lanes.

Who was in the wrong? Unable to tell with the information provided. From your discription however, assuming that the other vehicle was making a turn from a driveway or a U-turn, most probably they would be at fault. A review of the police report by a knowledgable law firm would provide you most of the answers to your questions.

The "top notch" law firms that specialize in personal injury will provide you with a free consultation, free case evaluation, no fee until money is recovered for you and they will advance all costs (this firm goes a step futher and waives all costs if there is no recovery). I strongly suggest that you take advantage of these services.

If you have been injured from this accident, I invite you to contact my firm for a free evaluation of your case. Please fax me the police report, if you have it, before calling.

Re: Side-swiped changing lanes.

You may be fault free if you were established in the street before the other car entered. However you really need to chart out the situation and go over it with an attorney.
