Legal Question in Personal Injury in California

small claims court

I was hit in the rear of my car in an auto accident. The defendants insurance company totaled my car and sent a check to cover its cost. They want to settle the PI for $200.00. If I accept the settlement can I sue the defendant in small claims court to recover what the insurance company did not give me in the settlement? Please respond via e-mail only thank you

You need an attorney.

Accepting the insurance company money, and signing a release, ends the case.

No. Once you accept the settlement you are done. If you do not like it, either talk to an attorney or file a lawsuit in small claims court.
