Legal Question in Personal Injury in California

What can be done?

I have a small claims pending for misappropriation of funds. Long story short, the defendant is seeking a change of venue. I can not afford to go to that county which is over 200 miles away. The funds taken came from a bank located in this county--thus I filed here. What can I do.? If I lose this I am really going to be upset. Thanks. I am the plaintiff.

Requests to change venue in Small Claims are rarely successful, but should still be opposed. You should check your paperwork to make sure that jurisdiction was stated in your filing documents. If not, file a declaration describing jurisdiction, and be sure to show up at the hearing date to either argue jurisdiction or proceed with litigating the case.
