Legal Question in Personal Injury in California

Small Claims Suit

Receved a service of a small claims suit. Plaintiff claims my dogs "attacked" him and is suing for lost wages and medical bills. I was unaware of this incidence and claim until I receved the service. Private party server entered property through a closed gate marked NO TRESPASSING and said "The court says you have to take this or go to jail"

Whether you knew of the incident or not you always need to file a proper answer with the court or you will be in default and found guilty. When someone is attempting service on you they may enter your property in order to properly serve you. You will not be arrested for not accepting service, but they will attempt to serve in other ways and you would be liable for the cost of those attempts.
