Legal Question in Personal Injury in California
My son was at a bar drinking almost a year ago. He needed to use the men's restroom which was outside. He went up the wrong up a flight of steps looking for the restroom through a door which was normally kept locked but they had been painting and it was unlocked that night. He fell to his death off the top of the steps. He was legally drunk. Do I have any grounds to sue the bar? Thank you for your time. I can not really afford an attorney.

Yes, you can sue the bar for negligence in not making it clear to their patrons where the bathroom is at. I would be happy to help you. I have an office in Sacramento and in Orange County. Even though your son was drunk, a drunk person is anticipated to exist at the Bar and the bar must take precautions to help even drunk people and not subject drunk people to an unreasonable risk of harm. You can call me on Monday at (916) 721--3324. Joe Marman
I'm sorry to hear about your loss! Most attorneys will take this kind of matter on contingency, where it would not cost you anything up front. The costs of litigation and attorneys' fees would come out of the settlement or judgment, if any. As Mr. Marman states, you can sue the bar for negligence. But don't wait!
I am sorry to hear about this. I dont want to start going into the specific causes of action or strategy, but it sounds like you have a very strong case. I recommend that you do not post facts on the Internet anymore, as you never know how such public disclosures will end up being used. You should meet with several attorneys, and choose one whom you like and trust to represent you on a contingency fee basis. I am happy to have you come in to my office for a free consultation, share my assessment of the case based on my experience, and then if you like me, I may be willing to represent you. I have handled serious personal injury matters before, including against large corporations and municipalities. Please send me an email, as I do not have your contact information.
