Legal Question in Personal Injury in California

My son was driving my mothers car and someone t-boned him in an intersection. My mom passed away but the car is still legally registered to her. Now the lady who hit my son and totaled my moms 2011 Honda Accord is claiming she’s severely injured and has retained an attorney. There was no insurance on our car (yes, I know....). Since my deceased mother is the legal owner can the other person still pursue her lawsuit?

Yes. She can sue the estate of your mother and your son. If you were entrusted with the car after your mother's death, you can be on the hook, as well.

The good news is that if your son was t-boned and there were no street controls in his direction of travel (stop sign, light, etc), a lawsuit would likely not be successful. Feel free to pm me further details at my lawfirm site if you want a free assessment of liability (robertreedlaw.com) - good luck.
