Legal Question in Personal Injury in California
My son was leaving the school parking lot when the car in front of him stopped suddenly. He braked but the front of his car hit lightly the rear of the vehicle in front. Our son stopped and prepared to exchange the insurance information, however the driver in front sped away.
After school the next day, he found a note from the driver that he had the incident with on his car windshield. The driver claimed that her car is damaged from the accident, if he would try to deny that it happened, she would report him to the police as a hit and run. She wanted him to pay for the damage.
My question is: She was the one that left the scene of accident, should that be a misdemeanor hit and run on her part, not our son? Since she left the scene of the accident, our son could not evaluate the extend of the damage to her vehicle, how would we know the damage now is caused by him? And the fact that she left him an accusative note, isn't this considered a harassment?

Neither your son nor her called the police. They both left the scene. You should call your insurance agent.
