Legal Question in Personal Injury in California

My son is 30 years old. Recently his new girlfriend talked him into letting her & her 2 children move into his house. He had a dog & it nipped one of the kids. He wanted to get rid of the dog & the girlfriend said no, begged him not to get rid of it. A few weeks later the dog bit the end of the other child's nose off. He took the dog out & shot it. The girlfriend was at an out of town hospital for about a week & when she came back she moved out. Now she is telling him that she is going to sue him for all medical expenses. The problem is he is on permanent disability due to a TBI and the only thing he has is his home. He did not have a home owner's policy at time of accident.

He could countersue her for the medical expenses for the children as well as their and his own pain and suffering (although, after the first "nip," he should have kicked out at least the dog). It doesn't sound like it was a good match between your son and his now-ex-girlfriend. I don't think a homeowners' policy would have covered his shooting of the dog, though, as it wasn't done negligently.
