Under normal circumstances, the statute of limitations for personal injury is two years from the date of the incident. This period of time can be shorter, however, if (for example) a governmental entity is potentially at fault for the collision (due to dangerous conditions on the road, etc). If a governmental entity is potentially at fault, the injured party must file a claim with the entity within six months of the incident. Because this analysis is fact intensive, you should contact an attorney as soon as possible.
