Legal Question in Personal Injury in California

How can I stop my neighbor from feeding my dog?

For twenty years I have been asking my neighbor to stop feeding my dogs. Again this morning I saw them trying to give them something through the fence. One of my dogs has died from pancreatitis (the vet said they get that from eating fat). Is there a legal action, civil or criminal, that I can take to stop him? Legally the dogs are my property and I believe he is damaging my property. Also, he is a police officer.

You must file a Restraining Order. Since it does not involve violence, you will probably have to pay the filing fee of at least $300.00. You will need a sworn declaration by you regarding the activities and be specific. If you can convince the judge or the court clerk, that violence may occur, with the death of your dog, the court may waive the filing fees.

These restraining orders, or "injunctive relief" can be very difficult to obtain in San Bernardino county which is where your zip code indicates you are from. You should consider hiring counsel to handle this that has handled non-violent restraining orders in the past.

My office has done so, and would be happy to discuss this with you.
