I sucked up a 1/2 inch piece of metal that was part of the metal lid to the hot fudge can in my milkshake. what are my rights

You can sue for damages, if you have any damages. You will have to prove that the metal came from the fudge.

You have to provide more information, such as did you swallow the metal, did it break off from the lid, what happened to you physically, any medical bills, etc.
