Can I Sue?

My car was legally parked on the street on May 14th when at 2:30am a motorcycle rider hit it head on going about sixty my car was not drivable and the rider of the motorcycle was killed. we had to rent a car so i could get to doctor appointments because I am pregnant. The car cost us out of pocket over 2,000 dollars plus we had to pay our deductible even though we pay our insurance for uninsured motorist the investigation is still under way so his insurance info. is unknown. My question is should we start a civil suit against the family and can i sue my insurance for harrasment since they have done nothing they have made us do all the foot work and only hassled us for money with no follow up with any info. from the other party. They have fought with us on everything and been no help just a burden. What can i do?

Retain a lawyer. Often, insurance companies won't listen unless their insureds have a lawyer, unfortunately. There are certain procedures when suing the estate of a decedent. You might check the Probate Code to determine what these are -- including time limits on making a claim.
