You can always sue whomever you want as long as you have a valid claim. I would suggest talking to a few attorneys to see who is a good fit for you for representation.
If your child's injuries are significant and required medical care, you may consider making a claim or suing the parents of the offending child who are liable for up to $25,000 for an intentional act of their child by statute. Since the child had bitten on prior occasions, if school personnel knew this, the school could be liable for not ensuring the safety of its students.
What is the extent of the injury? Were sutures required and/or will a scar remain? If the skin was punctured, you should tell your child's doctor to obtain advice or care to prevent infection.
The school and child's parents should certainly be made aware of the potential injuries or other health threats that can come from a human bite and take measures to stop the child's behavior before that child injures another.
