Legal Question in Personal Injury in California
Sue Question
I was attacked by SafeWay employees outside of the store, im not sure if they were on the clock or not but they did in fact work there, i was sent to the hospital because of it, i was told that safeway cannot be sued over it because they had nothing to do with it, but iv heard other things as well, im in california. hoping someone could tell me if that is true or not?

You need to provide more information on when, where in relationship to the store, how and why, to determine if there is potential employer liability. There should be a criminal investigation aspect to the matter which would impact the analysis.
Employers can have responsibility for the actions of 3rd parties, employee or otherwise, under certain circumstances.
A lawyer's analysis is going to be required.

It is not true as a rule. It is quite possible that you could have a case against Safeway. It depends very much on the facts, and you might not have all the facts you need. It might be necessary to hire a private investigator to interview witnesses. If there is a case, the sooner you get going on investigating, the better. If the employees' actions were within their normal course and scope of employement i.e. security gaurd, then it is very likely the store is liable for their employees' misconducts. call us at 213.388.7070 for an analysis of the incident.
