Legal Question in Personal Injury in California

Being sued to auto damage and personal injury

Road rage and long story short,my husband was in a fight with another motorist. He (my husband)kicked the other person's car and caused a laceration above his eye during the brawl. Now, we got a notice in the mail from his insurance company regarding damages to his car and personal injury. What can we do protect ourselves. Pur insurance is reviewing the claim but does not guarantee they will cover damages. How much will this cause us? If you can stir us to the right direction, I would greatly appreciate it.

Re: Being sued to auto damage and personal injury

Liability insurance does not cover intentional conduct. Depending upon its language, the policy *might* cover your husband if the other driver was the aggressor and your husband was only acting in self-defense. But if your husband started the fight or went beyond what was reasonably necessary to defend himself, he will have to pay for the harm he caused.

How much this will cost you will depend upon the nature of the other driver's injury, how much pain he suffered and the damage to his car. Without more information I can't begin to guess what the total bill will be.
