Legal Question in Personal Injury in California

I'm being sued and the date of the incident is wrong. Is it still legal and binding?

Getting some details wrong in the pleadings usually won't matter, even if the details are important. Most such errors can be addressed at or before trial. Whether that's true in your case will depend on the specifics. For example, it's possible that the lawsuit was untimely but that the incorrect date makes it look like the statute of limitations has not yet run.

You should discuss the details of your case with a lawyer, and should hire one to represent you if at all possible. Depending on the nature of the lawsuit and your insurance policies, the insurer might pay for your defense. There may be other ways to reduce the financial burden of hiring counsel.

Good luck.

Nothing that a simple amendment to the lawsuit couldn't cure.

Good luck
