Legal Question in Personal Injury in California

Being Sued

I was involved in a car accident during a temporary work assignment in USA.

Today, I received a claim from the plantiff's lawyer about some form of personal and distress damages cost which amount to about US$103,000.

What should I do now as I am currently no longer in USA and I was asked to attend an ADR - Alternative dispute resolution in USA.

Moreover, I do not have the money to pay for this huge amount of claim that the plantiff is asking for?

What should I do now.

Thanks

Re: Being Sued

If you had automobile insurance you should submit the claim to your insurance company. If you did not then you must defend it so as to minimize your liability. Please call me directly at (619) 222-3504.

did you or the car you were driving in have insurance, that should take care of it. If not, you better hire an attorney.

Re: Being Sued

Report it to the applicable insurance company immediately.

You mention that this case is being set for ADR, which seems to indicate that an answer to a complaint has been filed...

If you do not have insurance, you should obtain legal assistance as soon as possible.

Good luck...

Re: Being Sued

Thank you for your inquiry.

I would certainly report the accident to any applicable insurance carrier without delay. You have indicated that you were on a work assignment, which may mean that, if applicable, your employer has a duty to defend you and/or indemnify you. This should certainly be explored. Otherwise, I would hire an attorney for a defense without delay. If you are at fault in this situation, it may be that the claim is exaggerated and that a skilled attorney can negotiate an equitable settlement or a positive outcome at trial. Please feel free to contact my office if you are in need of such assistance.

Good luck.
