Legal Question in Personal Injury in California
i tested positive for TB,a friend who i had just met two months prior got extreamley ill. and asked if i could stay and help him,he had just moved to ca. from philipines,hes originaly from boston. i went to e.r with him, and that is when i discovered that he was allready infected with TB. they quaritined him for a week. can i sue him for neglegence and personal injury

To be successful in a suit, you would have to show he knew or reasonably should have known that he had a communicable disease and that the activity he engaged in with you could transmit the disease to you but he intentionally ignored that danger or did not bother to think about it or acted in a careless fashion. It probably will be difficult to prove all of the above. You will encountered some prejudice against you if it was the result of sexual relations.
