Legal Question in Personal Injury in California

Being threatened by participant at burlesque show who claims a neck injury

A patron at our monthly burlesque show tipped a dancer a dollar. She claims

the dancer took her head and twisted her head so badly while dancing with

her she got whiplash, nerve and muscle damage amongst other neck injuries

and wants our insurance card information and lost wages. The injury

happened on a Friday. We got an email from her on following Monday saying

she went to the doctor on Monday and claimed the doctor told her she had all

these injuries. She said if we dont give her our insurance information she will

take us to small claims court. I can't imagine a doctor could come up with this

hypothesis without doing Mri's, etc. What actions can we take to protect

ourselves.

Notify your insurance company about the claim, otherwise, your insurance may not cover you if in fact this person files suit against you. They should defend you in this action.

Ironically, I just heard about a similar case on the radio today.

You need to contact your insurance company ASAP. This is why you purchased insurance. If you do not have coverage, then you should personally get on the stage and dance so that you can get tips since you're going to need all the money you can get to fight this! Good luck.

Assuming you have coverage, I would notify your insurance company immediately. If you do not notify your insurance company of the claim, the insurance company may deny coverage. This the reason that you bought the policy.
