Legal Question in Personal Injury in California

a tow truck company had a truck hooked up to their cable in a dark parking lot of a walmart store. i was walking through the parking lot headed inside the store. the 3 tow employees stared at me as I walked towards them. They did not bother to warn me that they had a cable stretched out across the parking lot until I walked into it. The cable hit around my lower shin, tripping me. I flew to the ground ,busted my knee, shin, hands and foot. The well mannered tow guys stood there and stared at me. Didn't even offer a hand or an apology. Is there anything I can do?

Yes, you can sue them for negligence in acknowlegeing that they knew you were there, but they failed to take any precautions to warn you of the danger. They should pay your medical bills, lost income, and money to compensate you for pain and suffering.

I would love to say, "yes, they're negligent, everything�s wonderful, come on in!", but it's not that simple.

Negligence is a very strong possibility, but they might be able to claim comparative negligence given the fact pattern which you provided in your Lawguru question. This means that given the presence of the tow truck, and the placement of the car, they may claim that you should have known that they were in the process of hooking up a car and that you should have been cautious when walking past the vehicles.

With this said, I'm not saying that you don't have a case, in fact, I think given the level of your injuries, you may have a pretty good case. However, it is important to acknowledge their possible defense.
