Since you reported the accident to your insurance company, you don't have to worry about the legal ramifications, yet. I hope they assisted you with filing a Form SR-1. If the other driver sues you, then you should tender the defense of the lawsuit to the insurance company by IMMEDIATELY sending it a copy of the suit and other legal papers served upon you. Please let me know if you need further assistance.

In addition to Mr. Cohen's advice, you probably want to ask your insurance company what your limits are. In writing, authorize your insurance company to release the limits to the injured party. If you own assets and you have less than $100,000 in insurance per person, you probably want to speak to an attorney about any liability you may have over your insurance limits.

Sounds like your insurance company will deal with the defense of any legal claims against you... and what you really need is to see a DOCTOR right away to find out why you're falling asleep at the wheel! Do a google search on "sleep apnea." Good luck!
