Tresspasser treated at local hospital after homeowner finds him in yard

My husband, while tresspassing in a homeowners back yard, was attacked by the homeowner without provocation, chased out of the and onto public property where he was beaten severely and rendered unconscious. The police had to take him to the hospital. He has been charged with burglarizing the person's house (nobody saw him in the house)and is incarcerated while awaiting trial.

Does my husband have a case for personal injury and if so, is the statute of limitations stayed while he is in jail/prison?

there may be a case

If the facts are as you say they are, then he does have a case. The statute of limitations is one year and is not stayed while he is in jail
