It is hard to say based upon the facts you describe, especially since you do not describe what type of plate it was, its height or width etc. In addition to the necessary facts already mentioned, it will also depend on whether your landlord knew about the metallic plate you describe. In California, one must prove notice on the part of the party you want to hold responsible for your injuries, in this case your landlord. You must be able to prove that your landlord knew about the metallic plate that caused your injuries, but failed to take measures to repair the premises within a reasonable time before your injury occurred. Notice may be in the form of a written letter from you, verbal notice, or simply an inspection of the premises. If the metallic plate was there at the time you rented the place, your landlord probably had notice of it when he/she rented the place to you. However, you may also be held responsible to some degree if you knew the premises were dangerous, but continued to walk in that area. Again, in order to give you more advice you would have to be more specific about the type of metallic plate and its measurements. Our office has been handling these types of slip/trip and fall cases for over 16 years now. If you wish to discuss this matter further, please do not hesitate to contact our office at (310) 277-0997 or e-mail us at [email protected].
