Legal Question in Personal Injury in California

Our truck driver has been unsage backing on a highway because otherwise would have had an accident, as highway was too small to pass through. While backing up he got stuck on a rock.

We are of the opinion that this violation against vehicle code section 22106 would have not occured during a different circumstances. He did do so, to prevent an even bigger collition with the rock.

Do we have to expect any consequences from this "unsafe backing", when we file a claim against the state authority for this code violation?

Unfortunately you question does not make sense. Why do you want to sue the state? Do you want to sue them because your driver backed up into a rock and caused damage to your vehicle? Was your driver cited and you feel that you need to sue the state because the officer shouldn't have given him/her a ticket. If you can clarify things then we all can give your better advice.
