Legal Question in Personal Injury in California

underinsured

I was hit by an underinsured driver, do I have to settle with the amount being offered? He was covered for $10,000 on property and the Mercedes he hit before me took most of that. They have offered me $1100.00, which won't even make my car roadworthy again. It's not my fault that he was underinsured, but I am suffering for it. He blew a red light that I was waiting at to make a left hand turn. Thanx for any help with this..............

There are a number of issues here. I would be VERY surprised if the insurance company settled with the Mercedes without a settlement agreement with you. They would be exposing themselves to an "insurance bad faith" claim by their insured (the person responsbile for the accident), if they did.

That is just the start. You need the help of an attorney here. There are a number of insurance matters to consider, policies to review, and etc.

Remember that there are strict time limits within which matters must be resolved or actions taken, after which you may lose all of your rights. Some of those time limits are as short as six months.

In California underinsured insurance coverage applies to personal injury, medical expenses, lost wages, etc.

However, it does not coverage property damages. You should consult with an attorney regarding your possible damages that are covered by underinsured coverage.
