Legal Question in Personal Injury in California

Uninsured causes auto accident

I may have been at fault in a fairly minor auto accident. I do not currently have auto insurance. Two other vehicles were involved with minor to nor damage (bumper to bumper contact. One other driver complained of back pain, although she seemed to move and bend with minimal discomfort.

If I'm found to be at fault what is my worst case scenario? I am unemployed and don't really have assets. I do however drive a luxury vehicle (don't ask - I owe more on it than its worth) and I'm afraid others in the accident will look at me as the cash cow - which I definitely am NOT.

You do have some problems. The others will look to their own policies, namely the uninsured provisions of their policies. The insurnace co. will then look to you for payments that they have made. This could be quite expensive. The type of car that you drive does not have any bearing. You should consult an attorney. Because you asked for your worst case scenario, you may have already been cited for not having insurance, which is a misdemeanor, punishable by a $1,000 fine and six months maximum in jail, or both. You also can be sued and if you could not pay a judgment, your license would be suspended until you either paid off the judgment, or if and when you filed bankruptcy.

I should also mention that you can be sued by the driver for personal injuries within two years, or by the insurance company for any amounts they paid within three years, so you may have lawsuits continuing on into the future for a while.

Have you considered bankruptcy? From what you've described, this may be a viable option for you.

Worst case scenario means that you could have your license suspended by the DMV. It means that you could be sued by the other drivers and their insurance companies. It means that since you didn't have insurance, that your personal assets, if any, would be subject to garnishment should there be a judgment against you. It means you might be subject to criminal penalties for failure to carry automobile insurance. All in all, you really should have auto insurance. Good luck and thanks for inquiring.
