Legal Question in Personal Injury in California

Uninsured motorist backed into my door

Hello,

I was recently hit by an uninsured motorist, and he is at fault.

The vehicle was only insured to his ''Father''. I believe his father is the registered owner. I was wondering can i sue just the dad? or both of them?

Hello, my name is John Airola and I am a personal injury lawyer. When an uninsured person hits you, you file an uninsured motorist's claim with your own insurance. If you don't have uninsured motorist's coverage, you can certainly "sue" both the father (owner) and the driver. If the vehicle was owned by his "Father" and the father had insurance on the vehicle, then the chances are very good that the accident would be covered under the Father's insurance. This type of coverage would be typical. Otherwise, you can file under your own uninsured motorist coverage if you have it.

Re: Uninsured motorist backed into my door

you generally would sue both the owner and driver. If the owner/father has valid ins on the vehicle, then it's not an uninsured motorist case.
