Uninsured motorist

I was hit by a uninsured motorist. I want to know if I should rettain legal aid what can I get from the uninsured motorist as far as paying medical bills and so on. I have uninsured motorist insurance myself.

If you have uninsured motorist coverage, then your insurance company should pay for your property damages and bodily injuries, and then they would subrogate(that is, stand in your shoes) in going after the uninsured wrongdoer. While suing an uninsured motorist might result in a legal victory, whether or not they have assets to pay your judgment is another story. It may be that you have a viable case, however, more information is needed. As a side note, your uninsured motorist coverage should provide some coverage for your damages (however, without reading your policy I cannot tell for sure). UM covers medical bills, wage loss and pain and suffering. You still have to prove your case to your ins. co. and prove the responsible driver had no insurance. It can get tricky and complicated. First off the State Bar of California does not certify personal injury as a specialty. In other words no attorney can say they are personal injury specialist!! With that being said, 100% of my practice is personal injury. I have settled hundred's of cases and have done numerous trials. There are certain steps you need to take ASAP. Uninsured Motorist claims are different than insured 3rd party claims. I highly recommend that you retain an attorney to guide you through the process. You are entitled to general damages(pain & suffering, loss of enjoyment of life, emotional distress, etc.) and special damages, (out of pocket expenses and medical expenses) through your uninsured motorist coverage, up to the limits on the declaration sheet of your insurance policy. However, I can assure you that without an attorney you will not get even close to what you are entitled to 99% of the time. Here are three examples of uninsured motorist cases I recently settled. (1)A woman was rear ended by an uninsured motorist, she was legally drunk and was convicted of drunk driving. Her insurance company would not offer her anything on her UM claim. I settled the case for a little less than 30k without having to arbitrate. (2) A women was hit by an uninsured motorist while making an illegal left hand turn, she broke her pinky and had 2k in medical bills. I settled her case for 12.5k. (3)A women was rear ended had less than 2k in medical bills. Her insurance company's maximum offer was 6.5k, we went through binding arbitration and got a 12.5k arbitration award.
