venue- question
I was living in Arizona and was hit by a motorhome in Colorado, the other driver cited for careless driving.Both wife and I have closed head injuries, my insurance (USAA) refuses to pay medical after paying a small amount. The other driver from Tenn has paid nothing.I was born and raised in California, left for military duty and have returned to California three years ago. Where is the proper venure to bring action against USAA for breach of contract/bad faith etc.?USAA has offices in California and all other states.My insurance was renewed in various states and countries as it became due?

Venue can be determined by a couple of different factors. Where the defendant resides or as in this case where the corporate headquarters are located. Where the breach took place, which would be in your county. So you can file a lawsuit in the county where you reside or the county where the accident took place. Have you made a claim against the other driver's insurance? I would have to speak with you in order to determine the proper venue and if you even have grounds to sue yet.
