Legal Question in Personal Injury in California
I am a victim of rear end collision. The responsible party has accepted liability. I was admitted to emergency, was tested through X-RAY and MRI. Had swollen back, neck for a week. Now have tender neck and shoulders. It's been 4 weeks since accident on 16th May. I couldn't go to work for 4 days. I am a contractor with $45/hr of pay. I have medicine, ambulance and emergency copy's worth $400. Doctor has advised a physio therapy sessions. I have a 16month old. My husband had to fly back from work to address the emergency and was away from work for a week. Both of us have extremely busy work and personal life. This has resulted in lot of stress in the family. I am now scared of driving. Our car was totaled. We rented a car for 8 days. My husband had to visit many dealerships for the new car. How much compensation and what should I claim from the liable party apart from the medical pay? Pls help.

You are entitled to a reasonable compensation for pain and suffering, medical expenses, future medical expenses, loss wages and other economic losses such as loss of use, rental car and etc. There are many factors that determine a fair settlement offer, but we need more facts and details about yout accident. Also you need to know the other driver's policy limit that may limit how much insurance carrier will eventually pay (many instances most drivers have minimum coverage of $15,000). Dealing with an insurance company can be an onerous task for the injured party. The insurance company will attempt to do what it can to minimize what they pay to the injured person.
You may be well advised to consult with an attorney who will havndle this matter for you on a contingency fee basis.
