Legal Question in Personal Injury in California

My wife and I were rear ended by a person who ran a red light. The person who hit us did not have a license, but the car was insured. My wife suffered a slight shoulder injury and back injury. I have pain in my back and neck and still getting headaches every so often. I work as a warehouse worker, and I'm leary of returning to work to early because I do a lot of lifting and turning. This accident happened on the 29th of June, so I have not received a accident report from the police yet. There was a witness to the accident. My wife returned to work today, against my advice. Do you think it is worth pursuing an award from their insurance company?

First of all, I'm confused about the date of the accident. Did you mean June 29, 2010? If it was that long ago, you should definitely have a police report available by now.

As to whether or not it's worth making a claim, I'd say definitely. You and your wife have suffered damages. The other party is at fault. Why should you NOT be compensated? Don't do the insurance company any favors, they don't need it. Go after what's yours.
