Legal Question in Personal Injury in California
I am wondering what type of cause of action I have in CA for the following:
I recently added a friend to my credit card. The friend was having financial problems but assured me he had money coming in a few months (he showed me proof) and would pay me back. We agreed that he would not go over a certain amount per month.
Well, he racked up a huge amount on my credit card, and went over the amount we agreed upon. Now he won't pay me back because he says we never had an agreement that he'd pay me back.
Is this fraud? Breach of contract? What kind of cause of action do I have?

It's at least breach of contract. It's fraud if he intended to do this to you when he promised that he wouldn't.
You may have other grounds on which to sue, but I would need to know more about the facts before I could say whether you do or what they might be.
Good luck.
At least a breach of contract and maybe more.Like Mr.Hoffman says more info is needed.
He's still your friend?
