Legal Question in Personal Injury in California
Wrongly accused in a parking lot accident
6 mo. ago I was in a parking lot and I was accused of backing into a vehicle. The guy called the police department and said it was a hit and run. The person gave them my license plate number and a police officer tracked me down and he looked at my vehicle and I had no damage and the officer said nothing matched up with the guys vehicle, and the officer told me the guy had a lot of old dents and dings on his vehicle. The officer took pictures of my vehicle and took a report. I called my insurance that very same day and told them what I was being accused of and gave them the officers name and badge #. I never heard anymore and today my insurance called me about an accident, and I did not know what they were talking about until they mentioned the parking lot. My insurance said that the guys insurance may not have ordered a police report, my insurance is ordering one and I am bringing my vehicle to a auto body shop in a few days so they can do some measuring and look for any damage, this is 6 mo. later. If nothing is done as far as my insurance having to pay out a claim, can I subpoena the police officer and take this person to court? I swear it's not about the money it's about the head aches and stress it's caused me.

Yes. Cross that bridge when you come to it.

Let your insurance company handle this.

Let the insurance company handle it. That's what you pay them for. Forget about suing the guy.
