Legal Question in Product Liability in California
I have a product that I would like to patent. It's actually an already existing product that I took and made better. I have a sales pitch, pictures, and a prototype. At this time I cannot afford to pay for the patent (from what I am told there are 2 types; the $599.00 which covers your creation for 1 year, and the $15,000.00 patent which covers you for a period of 10 years.) I can afford neither RIGHT NOW. Perhaps the $599.00 in the near future. My question is - If I send the original paperwork to myself via conformational mail (a.k.a. the "poor man's patent"), will that hold up in court? I suggest you check out the book, "Patent It Yourself" from Nolo Press, available at www.nolo.com, or consult with a patent attorney. Your question isn't product liability, and I don't know if there's a category for that here. It's patent law, which is the subject of a separate, federal, bar exam - patent lawyers don't have to pass state bar exams, so it's not likely you would more specific advice here.
