Legal Question in Product Liability in California
out side of e-bay shopping
I bought Ibook rechargeble lithum battery from outside of e-bay.
He garantee replacement or refund if the battery is defective but he said he can not refund because I used it for try to charge.
I just know his e-mail address.How can I sue him?

E-bay and similar on-line auctions are a jungle. "Let the buyer beware" is the watchword of the day. If the battery was new, you can contact the manufacturer and see about a replacement. Otherwise you can sue in small claims court. Since the battery was delivered to you in California, you should have a predicate for jurisdiction. Collection of a judgment will not be easy, however.
