3 day notice

Was given on friday may 8, what day can i file the summons?

Actually, you don't file a summons. You fill one out for the benefit of the court clerk, who will then "issue" it if it is properly filled out and presented along with a properly-prepared complaint and the filing fee. Be sure to show up at the clerk's window with at least one extra copy of all documents (complaint, summons, civil case cover sheet, and anything else required under local rules). I'd say Tuesday the 12th would be the earliest to present and file your papers.

Assuming the tenant doesn't pay during the three-day period, you can file the unlawful detainer complaint on Tuesday, 5/12.
