Legal Question in Real Estate Law in California

30 day notice mid-month

My tenant is month to month, and just gave notice on the 17th of July, for a move out date of Aug 17th. Can they do this? or are they expected to pay until the end of Aug?

Re: 30 day notice mid-month

Thirty days' notice means exactly that; it doesn't have to be given on the first of the month, the last of the month, or on the same day of the month the rent is due. Notice any time of month suffices.

If they accept payment of rent for a longer period the notice would be waived. Otherwise they can do this.
