Legal Question in Real Estate Law in California

My 30-day notice rejected?

On Jan 1st I wrote my 30-day notice on my envelope, and even wrote ''last month'' on the check. On the envelope I gave on the neccisary info and my number to be reached on the envelope. I slid the envelope in the drop box. I never heard from them, so I assumed everything was alright and moved out by Feb. 1st. But now the Management says I didnt give the a 30-day notice and that the check doesnt count. They even have went as far as to say there was not envelope. Now they want me to pay for an another month of Rent ($416) or I am going to lose my deposit($400). Plus I have to pay for other damages to the appartment ($293). What do I do?

Regarding damages, they must prove there are damages of the sort allowed to be retained from a security deposit.

Regarding the 30-day notice, they probably would not be able to hold their interpretation up in court. Demand a full refund, and let them know that you will take them to small claims court if they do not comply with California statutes.

Generally, once you gave a 30 day notice and you followed through, you have no more liablity unless you did not have a month to month lease. I would be happpy to review your lease and all correspondence you have received without charge if you fax same to me at 714 363 0229.
