Legal Question in Real Estate Law in California
I'm 10 months in to a 12 month lease living in an 'upscale' west side complex with 500 units. My unit is at the end of a sewer pipe on the bottom floor so subsequently, we get frequent sewage backups and flooding. This has been ongoing since we moved in with at least six documented episodes, two of those to the health department (with complaints / reports). The vents in both bathrooms don't work, it's always damp and musty, I'm concerned about mold. The management has told us they will release us from our lease but they will not provide financial assistance to moving and getting a new place, I've asked. The problems persist (overflows, non-working ventilation) even though the health department has mandated that repairs be made. Do I have a case? If so, I need help. TNX

You might have a case. You certainly have grounds to get out of your lease early and get a refund on your deposit. You may be entitled to a partial refund of rent paid.
