30 Termination Notice

On June 28, 00, tenants were given a 30 day notice to increase rent $50.00. On July 5th I picked up the rent with a letter stating they could not pay the increase, because it was too "taxing to them" but did mention anything about moving. Can I serve them now with a 30 day notice to terminate or must I wait & see if they do pay the increase. Also in their letter they stated they wanted a 1/2 notice before we came over to clean the pool, because they wanted their privacy. In the past we have tried to call, and all we got was their answering machine that worked 1/2 the time. According to the Landlord Law book doesn't state giving any notice to outdoor maintenance. By Law do we have to give a notice to clean or put chemicals in the pool? The people we called at a Pool Svc Company stated they could not do this nor would they.

Please help.

if they are month to month you can give them a 30 day notice now or a 3 day notice when they dont pay the increased rent. re the pool, you have to give 24 hours notice before entering the property at all unless it is an emergancy. i would do it by mail.
