Legal Question in Real Estate Law in California

Over 1 year ago I was living in a rental home. I was residing there for about 4 years. After buying a home I moved out of the home that I was renting. Upon leaving the landlord conducted a walk through so that he could release the security deposit to me. The rental was left in good condition and I received my secuiity deposit from landlord.

A few months ago (through the utility companies I was advised that while I was living in the rental house I was paying the utilities for the family living in the house behind me. I re-contacted my previous landlord and requested that I be refunded for the utility bills. After getting nowhere with him a month ago I took him to small claims court and won the case. The landlord was ordered to pay me approximately $1300. A few days ago I received a notice from the court to appear in a small claims where the landlord is counter suing me for damages to the roof of the rental home saying that we should not have had cable tv installed. It is clear that the landlord just wants revenge. If we had left the home in bad condition, he would not have given us the entire security deposit back. Can he do this and if so how do we respond. to this complaint?

You have to go to court with all your documents. Based just on what is in your question I would think a judge would be very skeptical of the landlord's new lawsuit.

You are going to have to defend yourself. Bring copies of the documents to court, including the fact that you had previously sued him in small claims court and obtained a judgment. Bring proof that he mailed back the deposit to you as well.
