Legal Question in Real Estate Law in California

abandoned tv?

I bought a tv from circuit city in 10/04 w/ the 2 year extened warranty. 5/06 tv started having problems. I called and they would never come out or call back to fix it. Finally sued them in small claims court and they settled the day before. I have recieved the settlement but they were supposed to pick up the tv. Its been over 3 months and they still haven't picked it up. I've emailed the cc and talked to the store manger they said they would come get it, still it's in my living room. Is there a time limit to wich they can come get it. I don't want to get rid of it to have them come back 6months from now and go ''where's the tv?'' we want our money back type thing.

Re: abandoned tv?

Send them a certified/return receipt letter (keep a copy) telling them what was agreed to, and reminding them of their obligation. Set a firm date by which they need to pick it up. Explain that if they don't by that date, you will dispose of it as you see fit.
