Absentee landlord wants to get rent from the tenants or evict procedure

Since I moved out of Albany, NY to CA, one of my tenant always not pay her rent on time. She's now 3.5 month behind the payment. I have given her written notice about 35 days ago that she either need to pay me or she has to move out my apartment by 11/30/00. However, she ignored my notice, didn't pay off her balance and refuse to move out. She is a month to month tenant after her lease was experied more than a year ago. In the past two and half months, I have gaven many times of written notice to her about her late rent payment.

I have a friend taking care of my apartment now. And if I ask my friend to get rent from her, she thinks that we sent him to threnten her. Since both my friend and I don't have experience to deal this situation, what is our best action to let the tenant move out of my apartment and get the rents that she owns me.

Is my case too complex to handle by myself without a lawyer? If we need a lawyer in this case, what is the cost associated with the service?

I cannot tell from your question whether your tenant is in California or NY. If your tenant is in CA then you should retain an attorney to help you. If not then you need a NY attorney.
