Legal Question in Real Estate Law in California

Abstract of Judgement not released

An abstract of Judgment was

issued Dec 1st. I paid the full

amount Dec 2, 2008. They refused

to release it. A Demand Letter was

sent, and now they say only a

Partial Release is being made. The

Judgment included a Prescriptive

Easement for my Driveway. Can

you clarify if this should be Full

Release or Partial?

Re: Abstract of Judgement not released

From the facts you presented, if you paid the full judgment which was the basis of the lien, then the lien must be released. Send another demand letter, certified, return receipt, and keep a copy. If they still refuse, you might have to get an attorney involved, and perhaps seek the court's assistance and attorney's fees.
