Accessing Neighbor Yard to build pool

Can we get sued for accessing our neighbors side yard w/o permission? House is basically abandoned, and we have made every attempt (Letters, Certified Letters, internet people search, City Govt.) to secure their permission.

Have you checked where the tax bills are sent, utility bills?

Yes, you could get sued because you have no right to use their land and someone with a sharp eye would see that the pool is new and that you could not get it in without going across their property, which is a trespass. But maybe they will never themselves show up again. The likelihood of anyone finding out about what you did/will do goes down as the years pass, and if you restore their property to the condition it was in before they probably will not sue.
